1. Taraflar ve Konu

Konu: Alıcının Vega Concierge üzerinden elektronik olarak sipariş ettiği araç/yat kiralama ve ilgili hizmetlerin sunulmasına ilişkin tarafların hak ve yükümlülükleridir.

2. Hizmet Bilgileri ve Bedel

Hizmetin türü, süresi ve kapsamı rezervasyon onayında belirtilir. Hizmet bedeli, Alıcıya iletilen teklif/rezervasyon onayında yer alan tutardır ve aksi belirtilmedikçe vergiler dâhildir. Fiyatlar talep üzerine ve rezervasyon tarihindeki koşullara göre belirlenir.

3. Ödeme

Ödeme, Sağlayıcı tarafından bildirilen yöntemlerle (havale/EFT, kredi kartı vb.) yapılır. Rezervasyon, kararlaştırılan avansın veya bedelin tamamının tahsili ile kesinleşir.

4. İfa ve Teslim

Hizmet, kararlaştırılan tarih, saat ve yerde ifa edilir. Teslim ve iade koşulları, işbu Sözleşmenin ayrılmaz parçası olan "Teslimat ve İade Şartları" belgesine tabidir.

5. Cayma Hakkının İstisnası

Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesi uyarınca; belirli bir tarihte veya dönemde yapılması gereken konaklama, eşya taşıma, araç kiralama, ikram ve eğlence/dinlence hizmetlerine ilişkin sözleşmelerde tüketicinin cayma hakkı bulunmamaktadır. Bu nedenle işbu kiralama hizmetlerinde 14 günlük cayma hakkı uygulanmaz; iptaller aşağıdaki iptal politikasına tabidir.

6. İptal Politikası

Alıcı tarafından yapılan iptallerde: hizmet başlangıcına 14 günden fazla süre varken yapılan iptallerde ödenen bedel (varsa işlem/hizmet masrafları düşülerek) iade edilir; 7–14 gün kala yapılan iptallerde bedelin %50'si iade edilir; hizmet başlangıcına 7 günden az süre kala yapılan iptallerde ve gelinmemesi (no-show) hâlinde iade yapılmaz.

7. Sağlayıcıdan Kaynaklı İptal / Mücbir Sebep

Olumsuz hava ve deniz koşulları, seyir güvenliği, resmi otorite kararları veya mücbir sebepler nedeniyle hizmetin sunulamaması hâlinde Alıcıya öncelikle alternatif tarih/hizmet önerilir; kabul edilmemesi hâlinde ilgili bedel iade edilir. Sağlayıcının sorumluluğu her hâlükârda alınan hizmet bedeli ile sınırlıdır.

8. Alıcının Yükümlülükleri

Alıcı; verdiği bilgilerin doğruluğundan, gerekli belgeleri (kimlik, ehliyet vb.) ibraz etmekten ve kiralanan varlığı sözleşmeye uygun şekilde kullanmaktan sorumludur.

9. Uyuşmazlıkların Çözümü

İşbu Sözleşmeden doğan uyuşmazlıklarda, Ticaret Bakanlığınca ilan edilen parasal sınırlar dâhilinde Tüketici Hakem Heyetleri ile Bodrum Tüketici Mahkemeleri ve İcra Daireleri yetkilidir.

10. Yürürlük

Alıcı, rezervasyonu onaylayarak ve/veya ödemeyi gerçekleştirerek işbu Sözleşmenin tüm şartlarını okuduğunu ve kabul ettiğini beyan eder.

Provider: Canberk Bitiş, Türkkuyusu Mah. Kıbrıs Şehitleri Cad. Yüksel Çağlar İş Merkezi No: 78/26, Bodrum / Muğla — Tax: Bodrum Vergi Dairesi / 1780896309, info@vegaconcierge.com, +90 532 742 66 70. Buyer: the person whose details are given in the reservation form.

Subject: the rights and obligations of the parties relating to the car/yacht rental and related services ordered electronically by the Buyer through Vega Concierge.

2. Service & Price

The type, duration and scope of the service are stated in the reservation confirmation. The price is the amount shown in the quotation/confirmation sent to the Buyer and, unless otherwise stated, includes taxes. Prices are set on request and according to the conditions at the reservation date.

3. Payment

Payment is made by the methods notified by the Provider (bank transfer, credit card, etc.). The reservation becomes final upon collection of the agreed deposit or the full amount.

4. Performance & Delivery

The service is performed at the agreed date, time and place. Delivery and return conditions are governed by the "Delivery & Return Terms", which form an integral part of this Agreement.

5. Exclusion of the Right of Withdrawal

Under Article 15 of the Regulation on Distance Contracts, there is no right of withdrawal for contracts relating to accommodation, transport of goods, car rental, catering and leisure services that must be provided on a specific date or period. Accordingly, the 14-day right of withdrawal does not apply to these rental services; cancellations are subject to the cancellation policy below.

6. Cancellation Policy

For cancellations by the Buyer: cancellations made more than 14 days before the start of the service are refunded (less any transaction/service costs); cancellations made 7–14 days before are refunded at 50%; cancellations made less than 7 days before the service, and no-shows, are non-refundable.

7. Cancellation by the Provider / Force Majeure

If the service cannot be provided due to adverse weather and sea conditions, navigational safety, decisions of the authorities or force majeure, the Buyer is first offered an alternative date/service; if not accepted, the relevant amount is refunded. The Provider's liability is in any event limited to the service fee received.

8. Buyer's Obligations

The Buyer is responsible for the accuracy of the information provided, for presenting the required documents (ID, licence, etc.), and for using the rented asset in accordance with the Agreement.

9. Dispute Resolution

Disputes arising from this Agreement are subject to the Consumer Arbitration Committees within the monetary limits announced by the Ministry of Trade, and to the Bodrum Consumer Courts and Enforcement Offices.

10. Entry into Force

By confirming the reservation and/or making payment, the Buyer declares that they have read and accepted all terms of this Agreement.
